Terms of Service

These Terms of Service (“Terms”) govern your use of helpmepaint.art (the “Service”), operated by Clarabel Ulrike van Heerden, trading as helpmepaint.art, a sole trader based in the United Kingdom (“we”, “us”, “our”).

By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm you have a parent or guardian’s permission.

2. Your account

  • You're responsible for keeping your login details secure and for all activity under your account.
  • Tell us immediately if you suspect unauthorised access (helpmepaint.art@gmail.com).
  • We may suspend or terminate accounts that violate these Terms.

3. Uploaded content

Some tools let you upload reference images (“Your Content”).

  • You keep ownership of Your Content. We don't claim any ownership over it.
  • You grant us a limited licence to store, process, and display Your Content back to you, solely to operate the Service.
  • You're responsible for what you upload. By uploading, you confirm that you own the image or otherwise have the right to use it, and that uploading it doesn't infringe anyone else's copyright or other rights.
  • We don't review uploads before they're processed. If you upload something you don't have rights to, that's on you, not us.
  • We may remove content that we reasonably believe infringes someone's rights or breaches these Terms.

4. Copyright complaints

If you believe content uploaded by a user infringes your copyright, contact us at helpmepaint.art@gmail.com with a description of the work, a link to the material you believe infringes it, your contact details, and a statement that you have a good-faith belief the use isn’t authorised. We’ll review and, where appropriate, remove the material.

5. Acceptable use

You agree not to:

  • Use the Service for anything unlawful
  • Upload content that is illegal, infringing, or that you don't have the right to use
  • Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service
  • Use automated means to scrape or bulk-extract content from the Service without permission

6. Our content and IP

Everything else on the Service — the tools, trainers, code, design, and text (excluding Your Content and public-domain reference artworks displayed for teaching purposes) — belongs to us or our licensors. You may use it for your personal practice; you may not copy, resell, or redistribute the Service itself.

7. The Service is provided “as is”

We don’t guarantee the Service will be uninterrupted, error-free, or available at all times. We provide it “as is” and “as available,” without warranties of any kind, to the extent permitted by law. Nothing here excludes liability that can’t legally be excluded.

8. Limitation of liability

To the extent permitted by law, we won’t be liable for indirect, incidental, or consequential losses, or for loss of data (including uploaded images). Since the Service is free, our total liability for any claim is limited to £50.

9. Termination

You can delete your account at any time. We may suspend or terminate your access if you breach these Terms, or discontinue the Service at our discretion.

10. Changes to these Terms

We may update these Terms from time to time, updating the “Last updated” date and notifying you of material changes where reasonable.

11. Governing law

These Terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer-protection rights you have in your own country of residence.
